Euranka Sarl ("Euranka," "we," "us," or "our"), which provides AI-driven companion services (the "Service") accessible via our website located at www.coquette.ai, and any related applications, platforms, or services owned or operated by us. By accessing or using the Service, you agree to be bound by these Terms of Service ("Terms"), including all policies incorporated herein by reference.

If you do not agree to these Terms, you must discontinue using the Service immediately.

1. Acceptance of Terms

By accessing, using, or registering for our Service, you represent that you are legally capable of entering into a binding agreement and that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations. If you do not agree, you must not access or use the Service.

2. Eligibility

You may use the Service only if you are at least the age of majority in your jurisdiction. By using the Service, you represent and warrant that you meet this eligibility requirement and that all information you provide to us is accurate, current, and complete.

3. Description of the Service

Our Service provides AI-driven companionship, including text-based interactions, personalized conversation, and content recommendations. The Service may learn from your inputs to deliver a tailored user experience. We reserve the right to modify, update, or discontinue any aspect of the Service at any time without prior notice.

4. User Accounts

To access certain features, you may need to register an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain and promptly update your account information.
  • Keep your login credentials confidential and notify us immediately of any unauthorized use of your account.
  • Be responsible for all activities that occur under your account, whether authorized or not.

We reserve the right to suspend or terminate your account at any time if we suspect that it is being used in violation of these Terms or any applicable law.

5. Prohibited Uses

We maintain a zero-tolerance policy for any behavior involving:

  • Pedophilia, child exploitation, or any related discussions: The Service strictly prohibits any content, dialogue, or behavior involving minors or the promotion of child exploitation in any form. Violators will be immediately reported to relevant authorities.
  • Sexual or violent deviance: Users may not engage in or promote discussions, content, or actions related to sexual violence, bestiality, or other illegal or abusive activities.
  • Hate speech and discrimination: The Service prohibits the use of discriminatory, abusive, or hateful language directed toward any individual or group based on race, religion, gender, sexual orientation, nationality, or other protected characteristics.
  • Illegal activities: Users must not use the Service for any purpose that violates local, national, or international laws or regulations.

We reserve the right to investigate any suspected violations and take appropriate actions, including suspension or termination of accounts and/or reporting you to law enforcement authorities.

6. Intellectual Property

All content, features, functionality, software, and AI models provided through the Service, including but not limited to text, graphics, trademarks, logos, and code, are the exclusive property of Euranka and/or its licensors, protected by intellectual property laws. You acquire no ownership interest in the Service or its content. You may not use any Company trademarks without our prior written consent.

All customization options, templates, and generated Companions (including those created by users) are considered derivative works of Coquette.ai’s platform and are protected under copyright and related rights laws.

You may not reproduce, distribute, or use these Companions outside of Coquette.ai without explicit written permission.

7. Underage Policy

Minimum Age

The Service is not intended for use by individuals under the age of 18. If you are under the applicable age, you may not use the Service.

8. Payments

Subscription Plans

Once you've reached the limit of 10 messages, you'll be taken to the payment page, where you can choose either the monthly or annual subscription plan, payable by credit card.

Access and Benefits

After payment, you will receive unlimited access to the messaging system as well as 100 tokens per month that can be used to access extended features like image generation.

Automatic Renewal

Your subscription is set to renew automatically at the end of each subscription period, extending for the same duration. The payment will be processed automatically on the first day of the upcoming period.

9. Refund Policy

9.1 Subscription Refund

  • Refund Request Window: You have 24 hours after your payment to request a refund. No refunds will be issued if your request is made more than 24 hours after you have paid for our services.
  • Usage Limitation: Refunds will be denied if you have used more than 20 tokens, regardless of when you request the refund.
  • Technical Issues: We cannot refund in cases where there was a technical issue on the user's side.
  • Payment Methods: We can only refund subscriptions that were purchased via credit card.

10. Fulfillment Policy

10.1 Cancellation

You have the flexibility to cancel your subscription at any time by activating the "Cancel subscription" button. If you choose to cancel, your subscription will remain active until the end of the current billing period.

10.2 Access Upon Cancellation

  • Upon cancellation, you will retain access to your account until the end of the current billing period.
  • Any remaining tokens in your account will expire at the end of the billing period.
  • Previously canceled subscriptions cannot carry over unused tokens.
  • If a subscription or token purchase is refunded, the subscription is immediately canceled. All access to premium features and remaining tokens will be revoked at the time of refund processing.

11. User-Created Companions

11.1 Definition

Coquette.ai now allows users to create customized AI Characters (“User-Created Companions”) by selecting traits such as name, personality, appearance, and style from predefined options.

These companions are generated using Coquette.ai’s proprietary technology and intellectual property.

11.2 Ownership

All User-Created Companions, including their names, visuals, prompts, dialogues, and any derivative elements, remain the exclusive property of Coquette.ai.

By creating a Companion, you acknowledge that no ownership, copyright, or commercial rights are transferred to you.

11.3 Content Use

Coquette.ai may store, review, or reproduce User-Created Companions and their interactions for moderation, quality improvement, and safety purposes.

We may also use anonymized data from Companions to improve the service or develop new features.

Customization data used to create AI Companions is processed in accordance with our Privacy Policy. Coquette.ai does not collect or store biometric data, real-world likenesses, or any personal information that could identify another individual.

11.4 Removal & Moderation

Coquette.ai reserves the right to remove or suspend any User-Created Companion that violates these Terms, including but not limited to content deemed illegal, harmful, harassing, discriminatory, or sexually explicit beyond acceptable use boundaries.

Repeated or severe violations may result in account suspension or any legal actions in the most extreme cases (child pornography, for example).

11.5 Feature Availability

The "Create Your Own AI Girlfriend" feature is provided on an experimental basis and may be modified, suspended, or discontinued at any time. Coquette.ai does not guarantee the permanent availability of any user-created Companions.

12. Content Removal and Blocked Content Policy

We reserve the right to remove or restrict access to any content for violations of these Terms. Users may report violations to contact@coquette.ai. Our AI models are continuously reviewed to ensure compliance with these guidelines.

13. DMCA Policy

If you believe that any content available through our Service infringes your copyright, please send a written DMCA takedown notice to contact@coquette.ai.

14. Complaint Policy

If you have a complaint, please contact us at contact@coquette.ai. We will review and investigate all complaints and respond within a reasonable timeframe.

15. Dispute Resolution

Governing Law

These Terms are governed by the laws of Lausanne, Switzerland.

Arbitration

Any dispute shall be resolved by binding arbitration in Lausanne, Switzerland.

16. Indemnification

You agree to indemnify and hold harmless Euranka from claims, damages, or liabilities resulting from your use of the Service.

17. Disclaimer of Warranties

The Service is provided "AS IS" without warranties of any kind.

18. Limitation of Liability

Euranka is not liable for any indirect, incidental, or consequential damages arising from the use of the Service.

19. Termination

We reserve the right to terminate your access to the Service at any time, with or without cause.

20. Changes to These Terms

We may update these Terms at any time. Continued use of the Service after the changes constitutes acceptance.
